Need Quote for Exterior Preparation and Painting of Sexton's House at No. 1 Waikumete Road, Glen Eden. Quotation Due Date: Feb --- . All Quotations will evaluated on the basis of conformance with the scope of the works, and price. The lowest or any price submitted will not necessarily be accepted. 1.0 Scope of Work Description of Project This contract is for the exterior painting of the Sexton’s House, No.1 Waikumete Road, Glen Eden. The work includes the complete preparation and repainting of the exterior excluding the roof. Brief Exterior • Fascia’s, soffits, struts, finials, weatherboards, lattice work, post’s, baseboards - to be prepared and painted as per attached Wattyl Specification – Colour - Wattyl TBA. • All window sashes, frames and sills - to be prepared and painted as per attached Wattyl Specification– Colour – Wattyl TBA • Doors and architraves - are to be prepared and painted as per attached Wattyl Specification – Colour- Wattyl TBA • Downpipes – PVC & wrought iron to be prepared and painted as per attached Wattyl Specification –Colour – Wattyl TBA • Wall panels – fibrolite – to be prepared and painted as per attached Wattyl Specification – Colour – Wattyl TBA. • Decks – timber – to be prepared and painted as per attached Wattyl Specification – Colour –Wattyl TBA. • Steps – concrete – to be prepared and painted as per attached Wattyl Specification – Colour –Wattyl TBA. The Contractor may submit an alternative paint Supplier. However, detailed specifications for the alternative products must be provided with the tender submission, and Council retains the right to accept or reject the alternative. On completion of the contract all rubbish shall be removed from the site and the site left tidy. All tenderers are to ensure that they thoroughly inspect the site before submitting their price to ensure that they are satisfied with the extent of the work. No claim for additional payment will be recognized where based on the conditions and requirements that would reasonably have become known to a Contractor by a thorough site inspection. Any work not included in the defined scope of work shall be dealt with as a variation. Agreement needs to be made with regard to pricing of variations before work is carried out. 2.0 Timeframe • Defects Liability Maintenance period: 3 months 3.0 Constraints The Contractor is to only work the hours negotiated by Xtreme Painter’s Ltd prior to the commencement of the contract. The Sexton’s House is currently tenanted, so Contractors are asked to be considerate with the Tenant during the work. The toilet facilities at the Sexton’s House are not available for use by the Contractor. The Contractor must make their own arrangements for alternative toilet facilities. The Contractor shall be responsible for their own safety and for seeing that their actions or failures to act do not harm any other person. The Contractor shall also be responsible for the safety and health of its employees, subcontractors and the public. The Contractor at all times shall comply with the provisions of the Health and Safety in Employment Act 1992 and any subsequent amendments. 5.0 Protection of Property and Services The Contractor is to safeguard all property or underground or overhead services in and near the site. Should any property or services be damaged due to the Contractor’s works, the Contractor shall be responsible for immediately notifying the authority or property owner concerned and the Extreme Painters Ltd, and be responsible for the costs of repair to the damaged property/services. It is the responsibility of the Contractor to locate the actual positions of the services on the ground, to consult with the relevant network provider (power, gas, telecommunications, watermains and other services) prior to any excavation commencing. Approval to proceed with excavations is to be obtained from the controlling authority (in writing) after the location of the services. The Contractor is to treat all services as live until advised in writing from the service authority concerned that the service has been decommissioned. 6.0 Keeping the Site Tidy If working in a public area at the end of each work day the site in the vicinity of the works will be left clear and safe for the public. 7.0 Staff Behaviour It is expected that all Contractor staff on site in connection with the work will behave in a courteous manner towards members of the public and/or property owners. 8.0 Contactability of the Contractor It is important that the Contractor maintains regular contact with the Xtreme Painters Ltd and is themselves contactable by telephone, cell phone or fax. 9.0 Insurance Prior to commencement of the work the Contractor shall provide evidence of Public Liability Insurance cover for a minimum of $2,000,000.00. Such evidence shall be from the Insurance Company and not an Insurance Broker. Prior to commencement of the work the Contractor shall provide evidence of Motor Vehicle Third Party Insurance cover for a minimum of $2,000,000.00. Such evidence shall be from the Insurance Company and not an Insurance Broker. 10.0 Practical Completion When the Contractor considers that Practical Completion has been achieved they shall apply to the Xtreme Painters Ltd for a Practical Completion Certificate. 11.0 Liability for Defects The Contractor will be responsible for remedying defects in the contract works for a period of 6 months from the issue of Practical Completion. The defects liability period will take effect from the Practical Completion date agreed in writing by Xtreme Painters Ltd. Any defects of workmanship and/or materials during this time shall be made good by the Contractor at no expense to Xtreme Painters Ltd. The costs of damage caused by vandalism or accident shall be the responsibility of Xtreme Painters Ltd. 12.0 Defects Liability Retentions 5% of the contract sum will be held as retentions against the rectification of defects which are identified prior to the end of the Defects Liability Period. These retentions will be paid subject to all identified defects being rectified by the Contractor. 13.0 Contract Completion When the Contractor considers that completion of the works has been achieved (at the end of the defects liability period), they shall apply to Xtreme Painters Ltd for a Completion Certificate and final payment (as applicable). 14.0 Payments At the appropriate time the Contractor shall submit a claim based on the Schedule of Prices at the frequency listed below: • On completion of the contract. 15.0 Dispute Resolution In the case of a difference or dispute between the Contractor and Xtreme Painters Ltd arising out of the terms of this agreement or the performance by the Contractor of its duties under this agreement which cannot be resolved by good faith, negotiations will be referred to an independent mediator agreed by both Xtreme Painters Ltd and the Contractor. If the dispute or difference is not resolved in mediation it will be referred to arbitration by a single arbitrator agreed by the parties, or failing agreement, appointed by the President for the time being of Auckland District Law Society Inc., or the President’s nominee. The decision of the arbitrator will be final and binding on the parties. 16.0 Cancellation This Contract may be cancelled by Xtreme Painters Ltd in the following circumstances: a) The Contractor is in breach of its obligations under this agreement and fails to remedy that breach within a reasonable time after written notice is given to the Contractor specifying the nature of the breach, the actions required to be taken to remedy the breach and the reasonable period within which such action must be taken. Xtreme Painters Ltd Sexton’s House Exterior Painting Upon cancellation, the Contractor will immediately deliver up to Xtreme painters Ltd all property including correspondence, documents and papers belonging to Xtreme painters Ltd in the possession of, or under the control of the Contractor. 17.0 Conflict of Interest a) Xtreme Painters Ltd acknowledges that the Contractor, despite having been retained by Xtreme Painters Ltd in relation to the subject matter of this agreement, should continue to be free to pursue other unrelated professional opportunities and to accept instructions from third-party clients notwithstanding that pursuit of those opportunities or instructions may bring the Contractor and/or its third-party clients into direct conflict with the Xtreme painters Ltd. Where such circumstances occur the Contractor will be free to pursue those opportunities or to accept those instructions but before doing so the Contractor will: i) have regard to any legal duties or professional ethical obligations which might prevent the Contractor from pursuing that opportunity or accepting those instructions; ii) inform the third-party client of the general nature of the Contractor’s previous contractual relationships with the Council; and iii) in a case where the subject matter of the instructions is likely to be an element of commercial or political sensitivity, obtain the consent of the third-party client to disclose the general nature of the brief to the Council so that the Council is fully informed before any issues of sensitivity become a matter of public knowledge. b) Both parties agree that they will immediately advise the other if it is perceived that an actual or potential conflict of interest, or matter of political or commercial sensitivity has arisen, or will arise, between the interests of Xtreme Painters Ltd on the one hand and the interests of the Contractor and/or its third-party client on the other hand. The parties will negotiate with each other in good faith to resolve any conflict or matter of sensitivity in a manner which is reasonably satisfactory to the achievement of the legal, commercial or political objectives of Xtreme Painters Ltd and the professional or commercial objectives of the Contractor and/or its third party client.
