1.1 Builderscrack does not sell or rent your personal information to third parties.
1.2 We release account and other personal information only when we believe release is appropriate for legal compliance and law enforcement (including to government agencies with statutory law enforcement responsibilities); to facilitate court proceedings; enforce or apply our terms and conditions; or protect the rights, property, or safety of Builderscrack, our users, or others. Government agencies with statutory roles enabling them to request data from us includes but is not restricted to Police, IRD and the Ministry of Economic Development. Members can contact Builderscrack to ask whether such information has been provided.
1.3 If a dispute arises between you and another member, or you wish to take Dispute Tribunal proceedings against another member, you can contact Builderscrack or the Disputes Tribunal for a statutory declaration, requesting contact details for the sole purpose of making a claim.
1.4 From time to time Builderscrack may wish to forward your contact details on to partners. Builderscrack will always ask you for your consent before forwarding any details.
1.5 When the homeowner accepts contact with a tradesperson, various personal details may be provided to each party by Builderscrack. This information is limited to a) first name, b) last name, c) home or business address, d) phone number, and e) email address and may be provided either at the time of connection or at a later time.
1.6 In order to protect against accreditation fraud, if a tradesperson adds a valid accreditation to their trade account we may contact the owner of the accreditation and provide them with details of the trade account that entered their accreditation. Details may include trading name, director/owner name, and contact details.
2.1 Our quoting services enables Users to send a job request to us which we will match with relevant Tradespersons who can provide quotations for the job request. We forward these job requests directly to the Tradespersons suitable to provide the services to the User. The user's contact details (as chosen by the User) are forwarded to the Tradespersons. Information regarding a job request is stored on our servers.
2.2 It is the policy of Builderscrack to send our members email throughout the process of undertaking the quoting services and other email they have elected to receive, in addition to customary business communications (payment confirmations, etc.). Builderscrack will send newsletters and other marketing communications to members. Newsletters will contain clear and obvious instructions for how the member can remove himself or herself from that mailing list. It is our policy to immediately remove any member from any mailing list upon the member's request.
2.3 We do use email as a means of receiving feedback from our members, and we encourage you to email us with your questions or comments. Feedback provided by members will be published by us on our Website and will only be removed by us in our sole discretion.
Our Website's registration form requires you to provide us contact information and may also require demographic information. When you submit a job request, you expressly consent to being contacted by us and by our Tradespersons via phone, fax, email, mail or other reasonable means, at any of your contact numbers or addresses, in order that we may provide the Services set forth on our Website, service your account, reasonably address matters pertaining to your account or for other reasonable purposes related to our business. We may also require (at our discretion) a Tradesperson's registered company name or personal name, insurance policy details and references to complete a credit check and background check, prior to a Tradesman being approved to join our network. We may also use your contact information from the registration form to send you information about our Services and promotional material from some of our affiliated partners.
Builderscrack provides you with ways in which you can alter your personal data, including changing your email address, physical address, password, phone numbers, etc. Builderscrack will store previous email addresses against your profile to ensure compliance with our Terms and Conditions - specifically the use of one account per member.
We work hard to protect the security of your personal information, including credit/debit card information. We use Payment Express for all credit card transactions.
6.2 When you pay by credit card, we give you the option to save your credit card details to enable future invoices to be automatically direct debited. This will occur automatically if you sign up for Pro. In both these situations your credit card details are encrypted and securely stored by Payment Express.
6.3 It is important for you to protect against unauthorized access to your password and to your computer. Ensure you logout when you have finished visiting Builderscrack.co.nz, especially if you access Builderscrack.co.nz from a shared computer
7.1 A cookie is a piece of data tied to information about the user and stored on the user's computer. This is widely used among major websites. A cookie does not provide us with any personally identifiable information. It does provide details of your IP address, the computer platform that you use (e.g. Mac or Windows), the browser that you use (e.g. Microsoft Explorer or Netscape) and what domain you are accessing our sites from.

8.1 We use additional information to do internal research on our Users' and Tradespersons' demographics, interests, and behaviour to better understand and serve you. This information may include the URL that you just came from (whether this URL is on our site or not), which URL you next go to (whether this URL is on our site or not), what browser you are using, and your IP address (your current IP address is 188.8.131.52).
8.2 Users who login have their IP addresses recorded. This information will only be provided to legal authorities in cases of suspected fraud or for law enforcement purposes. This information is stored securely and will not be provided to other members or non-authorised parties.
8.3 If you choose to leave feedback for other Users, we will collect that information you provide to us.
8.4 If you send us personal correspondence, such as emails or letters, or if other users or third parties send us correspondence about your activities or postings on the Website, we may collect such information into a file specific to you.
9.1 We may post and publish Users' feedback and reviews of Tradesperson's performance, as well as feedback and testimonials at our sole discretion.
9.2 A Builderscrack Tradesman or User is only allowed to use the personal information communicated to him exclusively for the purpose of carrying out the Job.
9.3 To verify address data entered or to check the creditworthiness of our Tradespersons or Users we reserve the right to obtain information on the Tradesman or User through third parties. For this purpose, the information collected during registration including the name of the individual or the business, address and date of birth, if appropriate, are sent to a business credit agency or other credit reference agency to check the address and creditworthiness of the Tradespersons or Users in question. The credit agency is required to protect the data. In the event of any breach of contract (e.g. termination for failure to pay, debt recovery proceedings or enforcing a judgment), we may also send personal data to the credit reference agency. In such case the data will only be transferred and stored to the extent necessary to protect our interests or the interests of the general public. The Tradesman or User shall be informed of the intended recipient of the data before it is transferred.
9.4 Tradesperson business information such as address, telephone and company information will be provided to the Homeowner. Profile information describing the Tradespersons business is made publically available.
9.5 Unless otherwise selected, the Homeowner agrees to release their telephone and address information to the tradespeople they have choosen to connect with.

11.1 Some Builderscrack advertisers may request information directly from Users, or link to sites that do so. Builderscrack has no control over its advertisers' privacy policies, and encourages users to review such policies prior to submitting any personal information to them.
11.2 Builderscrack contains non-advertising links to a variety of third party sites to enhance the member experience. Builderscrack has no control of either the content or privacy policies of such sites, nor should such links be considered an endorsement of these sites except where otherwise noted.
