Consent for sleepout on border edge

I am wanting to get consent for a sleep out on the property border 3m by 3m room. Neighbour's are fine with it going in. We would like to replace the spa pool awning that is currently there. The house next door will soon be turned into 3x 3 story units by the developer and will be position on the far side of their property. Away from the fence line.
