Please consider our unfortunate experience before making your final decision. We began the project in July-August 2012 truing to finish before Xmas time. IG Construction gave us a lowest quote, the fixed price, which we accepted. He notified us that he will be busy in September and can start in October. But we were busy in October as it was our holiday and we would like to manage the project personally, so, we agreed to begin after our holiday. We asked him a number of times to confirm that he can finish before Xmas time and we got 100% assurance. When we returned from the holidays he informed us that he has another project at the same time as our project and he had to finish a current project which he got when we were away. He began the project in the November and we paid 50% deposit. His presents at our site was spontaneous, he can work a day and then not come back for a couple of days. The first problem happened with the retaining wall; he installed the posts which formed the line in the wrong angle. We contacted him and asked him that we put the project on hold for a day to clarify the angle. We agreed that it was the misunderstanding and we agreed to pay extra money to re-arrange the angle. To avoid the misunderstandings again we discussed other project details and they must be clarified before work goes ahead. After that we got the email notifying that he is going to charge us for the variations, and because of these changes, he is not able to finish the project by Xmas. We were very surprised and disappointed as the project price was fixed. We disagreed with him as we did not think the details which were discussed were major deviation from the initial quote. So he stopped the project. The communication with him was very slow as he was very busy with other projects. This give us an indication, why he compromised the project. After lengthy email discussion we agreed to give the project a second chance and we agreed to review the project with a new quote. Unfortunately the second quote was much higher, 30% more then the first quote, with which we cannot agree. We asked for the refund. he refused to return the deposit saying us that he is going to charge us on time and materials basis for the work he already done regardless of the fact that the project had the fixed price. We employed many tradesman before through the Builders Crack, but all of them were looking for customer satisfaction, trying to keep us happy and were flexible.

"The dispute that the Demeshev's refer to resulted after they requested significant upgrades to the features in the project, after it was underway. Our company made all reasonable efforts to settle this to our customers satisfaction, however this was not to be, including it would appear, after being resolved by the Disputes Tribunal. We would like to assure the customers of Builderscrack that this anomaly resulted from circumstances unique to this project."
